1. Acceptance of Terms

By accessing and using MySenda, you agree to be legally bound by these Terms of Service. If you do not agree with any part of these terms, you must not use our services.

2. Service Description

MySenda is a digital platform that facilitates the connection between travelers and local tour guides. We act solely as a directory and contact facilitator. MySenda is an independent technological tool and not a travel agency or tour operator.

We do not organize or control the tours offered by guides. Booking services is a direct agreement between the traveler and the guide.

3. User Accounts

To access certain features, you may need to register. You are responsible for maintaining the confidentiality of your account and all activity occurring under it. You must provide accurate and up-to-date information.

4. User Conduct

You agree not to use the service to:

  • Post false, inaccurate, or misleading content.
  • Harass, threaten, or defame other users or guides.
  • Infringe intellectual property rights or privacy.
  • Engage in fraudulent or illegal activities.

5. Guide Responsibilities

Guides are independent professionals responsible for the quality, safety, and legality of their services. MySenda verifies certain data but does not guarantee the performance of any guide.

6. Limitation of Liability

MySenda shall not be liable for any damages, injuries, losses, or disputes arising from interactions or transactions between users and guides. Any claim related to a tour must be directed to the relevant guide.

7. Payments

Most transactions are agreed upon and made directly between the traveler and the guide (e.g., cash payment or direct transfer). MySenda does not charge commissions for these direct transactions and is not responsible for processing these payments or issuing refunds.

8. Intellectual Property

All platform content (design, logos, text) is owned by MySenda or its licensors and is protected by copyright.

9. Applicable Law

These terms shall be governed and interpreted in accordance with the laws of Mexico. Any dispute shall be submitted to the exclusive jurisdiction of the competent courts in that jurisdiction.
